The short answer

On 8 October 2026 the EU securities regulator ESMA published an opinion telling national supervisors that licensed crypto-asset service providers (CASPs) should not offer any service, from trading to custody, in stablecoins whose issuers do not meet MiCA. Where platforms still have such exposure, supervisors should require it to be cleaned up "no later than three (3) months" after publication, which by our count is 8 January 2027. After that, the only services left should be selling, converting, transferring or withdrawing existing holdings. The opinion names no token, but ESMA's own register of authorised e-money token issuers includes Circle and Paxos and does not include Tether, which is why the market reads it as a deadline for USDT on EU platforms.

What the opinion actually says

The document is an ESMA opinion (reference ESMA75-113276571-1742) addressed to national competent authorities under Article 29(1)(a) of the ESMA Regulation. It is a supervisory expectation, not a new law, but national regulators use such opinions to apply MiCA consistently. The key points:

  • No services, full stop. "CASPs should not provide crypto-asset services in relation to ARTs or EMTs that are not compliant with the applicable requirements under MiCA." ARTs are asset-referenced tokens; EMTs are e-money tokens, the category that covers single-currency stablecoins.
  • Every service counts. Supervisors should look at whether a platform's services, alone or combined, let EU clients acquire, trade, exchange, subscribe for, increase exposure to, or otherwise access or keep non-compliant tokens. ESMA lists operating a trading platform, exchange, order execution, reception and transmission of orders, placing, advice, transfers, custody and portfolio management.
  • Warnings are not enough. ESMA says risk warnings, disclosures or client acknowledgements would not address the problem, because clients cannot realistically judge what is missing when an issuer is outside MiCA.
  • Orderly wind-down is allowed. Supervisors may let platforms keep strictly limited residual services to avoid harming clients: liquidation, conversion, withdrawal, transfer or safekeeping of existing holdings. These must be time-limited, clearly communicated and closely supervised, and must not allow new purchases or promotion.
  • Three months. Where legacy exposure remains, supervisors "should require remediation as soon as possible and no later than three (3) months following the date of publication."

ESMA says the opinion builds on the European Commission's Q&A 2404 and its earlier public statement on non-compliant stablecoins, and that it does not change those positions; it extends the expectation to every type of service rather than only trading.

Which stablecoins are affected

The opinion defines non-compliant tokens by status, not by name: ARTs or EMTs whose conditions for a lawful offer to the public or admission to trading in the EU are not met. To see who meets them, we checked ESMA's interim MiCA register of e-money token white papers on 11 October 2026.

The register is ESMA's interim list and is updated periodically, so check it before acting. On that reading, USDC and EURC are compliant EMTs, while USDT is not, and platforms authorised under MiCA should be winding down USDT services for EU clients.

What changes for you

If you hold USDT on an EU-licensed exchange. Expect your platform to announce sell-only or convert-only treatment before 8 January 2027, if it has not already. You should still be able to sell, convert to a compliant stablecoin or euros, or withdraw to a wallet you control. Buying more, using USDT as a trading pair or earning yield on it should stop.

If you trade with USDT pairs. Euro pairs or USDC pairs are the likely replacements on EU platforms. Check whether your venue already lists them for the assets you trade, and how its fees compare.

If you hold USDT in your own wallet. The opinion is addressed to service providers. It does not regulate what individuals keep in self-custody, but it does reduce the number of EU platforms where you could later sell or convert that USDT.

If you use a non-EU platform. MiCA authorisation is what brings a platform under this opinion. Platforms that serve EU residents without authorisation face a separate problem; ESMA's CASP register shows which firms are authorised and by which supervisor. Among large exchanges it lists, for example, OKX Europe Limited (Malta), Bybit EU GmbH (Austria), Coinbase Luxembourg S.A. and Kraken's Irish entities.

How to act on this

Do it on your schedule, not the platform's. Converting early avoids a rush near the deadline, and it is worth checking the spread on the USDT-to-USDC or USDT-to-EUR conversion before you click. If you trade regularly, fees matter more than the one-off conversion. OKX's EU business is authorised in Malta according to ESMA's register; NexuAlpha's partner code nexu888 returns 40% of trading fees on OKX, settled hourly, but OKX's referral FAQ says referral rewards across different regions or entities apply only where the programme supports them, so confirm eligibility on your sign-up page. See the OKX profile, compare venues on /rates, and read our guide to checking a firm on the MiCA register. For the USDC side, see Circle's MiCA redemption boundary.

Quick answers

Is USDT banned in the EU? Not for individuals. ESMA's opinion says MiCA-authorised platforms should stop providing services for non-compliant stablecoins; Tether is not in ESMA's e-money token register.

When is the deadline? Supervisors should require remediation no later than three months after the 8 October 2026 publication, which is 8 January 2027.

Can I still withdraw my USDT? Yes. The opinion allows residual services including withdrawal, transfer, conversion and liquidation of existing holdings.

Does it affect USDC? Circle Internet Financial Europe SAS is in ESMA's register with USDC and EURC white papers, so USDC is treated as MiCA-compliant.

Is the opinion legally binding? It is a supervisory opinion to national regulators, not a regulation, but those regulators enforce MiCA and are expected to apply it.
